BOISE, Idaho (CBS2) — Justin Lum of Fox 10 (@jlumfox10) is reporting that Lori Vallow’s trial, set for January 9, 2023, has been vacated by the judge until a further investigation into her competency can be conducted.
This comes after a sealed motion presented to the court was filed yesterday, October 5, 2022.
Judge Steven Boyce has determined under a shortened review yesterday, that not enough information has been provided to determine the defendant, Lori Vallow’s, competency.
The motion states that with no definitive amount of time allotted for such a determination, it is impractical to move forward with the assigned court date of January 9, 2023, at this time. The case has been vacated until such a time that the defendant’s competency has been satisfactorily assessed and a new trial date can be determined.
This comes on the heels of the Idaho Department of Health and Welfare stating that they have no intention of taking any further part in the trial as reported yesterday.
Lum also reports that this will affect Chad Daybell, as the two are currently joined under the same trial. Chad Daybell’s attorney’s filed a motion last week to have the two trials separated and for a continuance to start no earlier than October 2023. The court has not yet had the hearing to determine whether or not the two trials will be separated, and it is currently unclear whether the Judge intends to move forward with that hearing as planned.
